This Privacy Policy explains how Next Step Filings, LLC (“Next Step Filings,” “NSF,” “we,” “us,” or “our”) collects, uses, and shares information when you visit nextstepfilings.com or its order pages (the “Site”) or purchase our services. It is incorporated into our Terms and Conditions.
Next Step Filings is a privately owned, third-party document preparation and filing service. We are not a government agency and are not affiliated with any government entity. We are not a law firm and do not provide legal advice, and we are not a certified public accounting firm and do not provide tax or accounting advice.
1. Information We Collect
Information you provide to us. When you place an order, contact support, or subscribe to our newsletter, we collect information such as: your name, email address, phone number, and mailing address; your business entity’s name, formation state, state entity or registration numbers, registered agent details, principal office address, and member or officer information; the content of your communications with us; and any other information you enter on an order form.
Sensitive information for specific services. Certain filings require additional information. For example, EIN applications require the responsible party’s Social Security Number or Individual Taxpayer Identification Number. We collect this information only when the service requires it, use it only to prepare and submit that filing, and restrict access to it internally.
Payment information. Payments are processed by third-party payment processors. We receive confirmation of payment, the payment method type, and billing details needed to service your order. Full card numbers are handled by the processor, not stored on our systems. [CONFIRM: name your payment processor(s), e.g., Stripe, and verify that no full card data touches NSF systems.]
Information from public records. We obtain business contact and status information from public state records, such as Secretary of State and State Corporation Commission databases. We use this information to verify filings and, in some cases, to send compliance reminders and offers to businesses with upcoming filing obligations.
Information collected automatically. When you use the Site, we and our service providers collect device and usage information such as IP address, browser type, pages viewed, referring pages, and timestamps, using cookies and similar technologies. 2. How We Use Information
We use the information we collect to: prepare and submit your filings to the relevant government agencies and deliver the services you purchase; communicate with you about your orders, filings, and compliance dates; send compliance reminders and marketing communications, which you can opt out of at any time; operate, secure, and improve the Site; verify identity and prevent fraud, abuse, and misuse of our services; comply with legal obligations and enforce our agreements; and respond to lawful requests from public authorities.
We do not use your information to provide legal, tax, or accounting advice, and we do not make automated decisions about you that have legal or similarly significant effects.
3. How We Share Information
We share information only as needed to run our business and deliver your services:
Government agencies. Completing a filing requires submitting your information to the relevant government agency, such as a Secretary of State, State Corporation Commission, or the IRS. Information submitted in a filing may become part of the public record under that agency’s rules.
Service providers. We use third-party providers for payment processing, website hosting, email delivery, printing and mailing, shipping, and customer support tooling. They receive only the information needed to perform their function and are required to protect it.
Professional advisers. We may share information with our lawyers, accountants, and insurers where necessary.
Legal requirements. We may disclose information to comply with law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of NSF, our customers, or others.
Business transfers. If NSF is involved in a merger, acquisition, or sale of assets, customer information may transfer as part of that transaction, subject to this policy.
We do not sell your personal information, and we do not share it with unrelated third parties for their own marketing. 4. Cookies and Your Choices
The Site uses cookies and similar technologies for functionality and analytics. Most browsers let you block or delete cookies through browser settings, though parts of the Site may not function properly without them. 5. Marketing Communications
You may opt out of marketing emails at any time by using the unsubscribe link in any message or emailing hello@nextstepfilings.com. To opt out of postal mail offers, email us your business name and mailing address and we will suppress future mailings. Opting out of marketing does not stop transactional messages about an active order.
6. Data Retention
We keep order and filing records for as long as needed to service your business, meet legal and tax record-keeping obligations, resolve disputes, and enforce agreements. Filing records are typically retained for at least the period during which a filing could be questioned or need to be re-produced for you. Sensitive identifiers collected for a specific filing, such as an SSN for an EIN application, are retained no longer than needed for that filing and associated record-keeping. 7. Security
We use administrative, technical, and physical safeguards appropriate to the nature of the information we handle, including access restrictions and encrypted transmission of order data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you as required by applicable law.
8. Your State Privacy Rights
Depending on where you live, state law may give you rights over personal information, including the right to know what we hold about you, to access a copy, to correct inaccuracies, to request deletion, and to opt out of targeted advertising, sale, or certain profiling. States with such laws include Virginia, Connecticut, Colorado, New Jersey, Oregon, and Utah, among others. Some of these laws apply only to businesses processing data above certain volume thresholds, and some exempt data processed in a purely business-to-business context. Regardless of thresholds, we honor reasonable requests to access, correct, or delete your personal information.
To exercise any right, email hello@nextstepfilings.com with the subject line “Privacy Request,” and include your name, your business name, and the email address on your account. We will verify your identity before acting and respond within the time required by applicable law, or within 45 days if no specific period applies. If we decline a request, you may appeal by replying to our decision with “Privacy Appeal” in the subject line, and we will respond to the appeal as required by law. We will not discriminate against you for exercising a privacy right.
Note that we cannot delete information from government records. Once a filing is submitted, the government agency controls that record, and requests to change it must go through that agency’s own process.
9. Children
The Site and our services are intended for business use by adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
10. Third-Party Sites
The Site links to government websites and other third-party sites. Their privacy practices are their own, and this policy does not cover them.
11. Changes to This Policy
We may update this policy from time to time. The “Last Updated” date above reflects the most recent version. Material changes will be posted on this page, and where required by law we will provide additional notice. The version in effect when you place an order governs the information practices for that order.
